They must not know that in many places a first offense of drunk driving is just a fine and a temporary suspension of driver's license. Just like with the cell phone laws. Criminal and illegal don't always mean jail time.

There are public figures who are not given the benefit of the doubt, for example, the case of John Galliano who headed the house of Dior who was swiftly terminated in March this year for making anti semitic remarks in public. This is what happens in the real world they aren't protected from their bad behavior.

Criminal does not just mean felony. A misdemeanor is a lesser criminal act but it's still a criminal act. Aggravated domestic violence is still considered a misdemeanor in many places. So is accidental homicide and manslaughter.

Most first DUI, second DUI, and third DUI arrests are charged as misdemeanors in the state of California and most other states unless the driver is involved in accident that kills or injures another person.

Then there is that wobbler law in California where the at fault factor comes into play.


Some DUI felonies are also termed "wobblers." Wobblers are punishable either by confinement in county jail or state prison. Wobblers differ from straight felonies in the punishment imputed and in the post-conviction relief available. If a wobbler is punished by incarceration in county jail and probation is imposed upon release, then the defendant may petition the court to reduce the felony to a misdemeanor. If granted, the conviction will be considered a misdemeanor, but is still a felony under the Three Strikes Law.

If the driver of a vehicle drives while under the influence of alcohol and/or drugs and commits a forbidden act or neglects a duty imposed by law in driving the vehicle which was the proximate cause of the traffic collision and injures someone other than himself, then the DUI is a felony. However, the driver must be "at fault" for the traffic collision.

If the driver is under the influence of alcohol and/or drugs, and is not at fault for the traffic collision, then the driver shall be charged with a misdemeanor.

Most DUIs aren't regarded as felonies either as you have been shown. Not being regarded as a felony doesn't make the act less illegal.

Andrew Cuomo said today that he will introduce a bill to toughen state provisions intended to protect people from drivers who text or use portable electronic devices of any sort behind the wheel. The bill closes loopholes and adds stricter penalties for distracted driving, which contributes to more than 10,000 crashes per year in New York state.

In a statement, Cuomo cited research showing that texting drivers exhibit worse reaction times than drunk drivers.

“Every day, countless drivers, particularly teenagers and young adults, drive with their eyes on a screen rather than the road,” said Cuomo. “Current warnings, educational programs, and driving laws aren’t working. We need to impose a true deterrent to stop people from driving while using an electronic device and to keep our roads and citizens safe.”

Advocates applauded the governor’s announcement, with Transportation Alternatives calling the Cuomo bill “groundbreaking.”

In 2008, 11,773 people were killed in alcohol-impaired driving crashes, accounting for nearly one third (32%) of all traffic-related deaths in the United States.

In 2009, 5,474 people were killed in motor vehicle crashes that were reported to have involved distracted driving.

Of those killed in crashes related to distracted driving, 18% of fatalities involved reports of cell phone use as a distraction.

18% of 5,474 as opposed to 32% (11,773) completely related fatalities to drink driving in the previous year.

Do you think people here are against laws prohibiting the use of electronic devices while driving?

I personally want to smack people that I see talking on their phones in their cars because I've nearly been run over by them multiple times. My state has a law against texting while driving, but I think it needs to go further.

That said, drinking and driving is already illegal everywhere (that I know of, at least).

There's no fucking argument here. Just people trying to derail and deflect.

11:13, I started about 7 and a half years ago, literally on a whim. ^_^ I wanted to be like Tifa from Final Fantasy, so I called up the closest Kung Fu school I could find, and went for a trial class. I thought i was too old to start, since I was 31. But here I am, seven years later, about to have my bai shi ceremony and I've never felt better. :D

You should really do it! Karate and the Japanese styles are very hard and forceful. I like Kung Fu because you don't have to strain yourself to do a lot of damage; all the movement comes from your legs and waist and you don't really "muscle" anything. Sifu calls it "physics over physique." That said, I lost 20 pounds doing Kung Fu, and kept it off, and not once did I ever feel like I was "working out.

Although I think that everyone who does a style feels that theirs is the best. ^_^ I think in that case, it's the best for them. People defending drunk drivers piss me off. Sadly I don't need national statistics to know that a driver under the influence, ANY influence, will possibly kill someone. 7 is the number of car crashes i have lost people close to me in. 2 is the amount of years its happened in. 16 is the number of funerals I have attended, and I have to attend another one this weekend. So forgive me for not having a whole lot of sympathy for Ryann Dunn.

People who have no compassion for drunk driving fatalities when the driver is the only one killed but will make excuses and have compassion for people who are killed or injured while texting or using their cell phones when driving.

People who get behind the wheel should have their full attention on the road and all of their wits about them.

It seems to me that some are trying to defend drunk driving by saying that using cellphones is worse. It isn't.

I lost someone dear to me because a woman who was a repeat offender who had lost her license got behind the wheel with a blood alcohol level of nearly .20. She had absolutely no idea she was driving on the wrong side of the road when she hit my friend head on.

Yes, talking or texting on cellphones is stupid. I even knew a man who was run over by someone while he was riding his bike because the woman who hit him was adjusting her radio and didn't see him. Both of these women were wrong, and both wound up doing jail time.

According to the NHTSA, about twice as many people are killed by drunk driving than distracted driving.

Both are stupid. Both should be illegal. I don't see anyone disputing this.

The distracted driving campaign is following the same formula as the campaign against drunk driving hoping people will realize just how dangerous and deadly it can be. How unacceptable and irresponsible it is.

The DD ads look a lot like the PSA's against drunk driving for a reason. They are equally dangerous and potentially deadly for the driver, their passengers and pedestrians. That's the point.


If you wouldn't get behind the wheel of a car after drinking alcohol then you shouldn't use your cell phone to talk or text while you're behind the wheel of a car. Both actions pose the same risks to life.

That UK ad is extremely graphic and shocking. The texting driver still living and screaming when she sees her bloodied and dead friends in her car. A dead baby in another car and a child asking why mommy and daddy won't wake. That's powerful.

That could explain why a few of you are having such a problem admitting and accepting that distracted driving, especially texting or using a cell, is just as reckless and irresponsible as driving under the influence of alcohol. Because if you and your family or friends do those things they can't possibly be as irresponsible, dangerous, reckless and stupid as drinking and driving. Is that it?

I personally want to smack people that I see talking on their phones in their cars because I've nearly been run over by them multiple times. My state has a law against texting while driving, but I think it needs to go further.

That said, drinking and driving is already illegal everywhere (that I know of, at least).

There's no fucking argument here. Just people trying to derail and deflect.

I personally do not use a cellphone nor text when I drive and neither do my family members. I can't vouch for my friends, but if they did and were involved in a fatal accident, I would consider it just as bad as if they were drunk. I'd wager most of the people here would say the same.

You're arguing about nothing. Drunk driving does kill more people than distracted driving, though. That's just a fact. That doesn't make distracted driving any less stupid. But nobody here is saying it isn't stupid, nor are they condoning it.

I honestly don't think that 17 year olds should be even getting behind the wheel, but I guess that way of thinking is impractical. They don't have the frontal lobe function yet to make decisions an older person might make. They don't have the foresight or reaction times.

I've never texted while driving. I've never actually texted. The only cell phone I own is a 2004 Nokia and it's hardly ever on. I don't even know the phone number to it.

MCR are one of the most mocked bands going in the rock scene, and if you want to see how many male rock fans dislike them, just go on the Kerrang forums or the Blink 182 forums. They're mocked regularly and sometimes other bands rip into them, like Kasabian and Manson. Gerard won't react to that with threats of violence because he only picks on girls, using gendered insults. This is very true. Many Blink fans are not at all happy that MCR is playing with them on the Honda tour.

You can find a lot of negativity towards MCR on Reading/Leeds boards too.

Any time MCR plays a festival, there are a lot of haters (mostly guys) who heckle them. There were LP fans at ProRev who were yelling for MCR to get off the stage all through their set. It's probably only going to be worse now that they're playing such pop-influenced music.

I don't see any problems with hugging, as long as it's all consensual, (not ninja hugs) and hands stay where they are supposed to. I know Jared Leto hugged me once, he even shoved me a little, in a playful way, and laughed when I giggled like an idiot. And I realize I unthinkingly touched his arm once to get his attention when I'm usually really good about not touching people I don't know. Also their tour-bassist Tim, he hugged my younger cousin and I both, once, and we somehow all ended up walking through the venue parking lot hand in hand, I still have no idea how that happened.

Yet another time, Bert McCracken bodily lifted up that same cousin of mine and moved her out of his way as he was running past. That, I thought was rude.

Touching is all about context. It should never veer into groping or invading personal space.

I can answer no to all 3. Another thing: in distracted driving there sometimes is plain old human error and judgment which doesn't involve texting, cell phones or whatever. That can happen in a blink of an eye. Unfortunately that can't be prevented. Drink driving is a substance controlling your ability to judge. Take away the alcohol in those cases and you prevent the accident.

It can, and it's terrifying. I like cars, I like driving. But at the same time, cars will probably always intimidate me a little. They are such deadly weapons. My aunt was recently (well, 4 months ago) in a horrific car accident. She lost her leg and is still in the hospital, having ups and downs. The car she was in was crushed, it didn't even look like a car anymore. Human error, on both sides of the accident. Just awful, so frightening.

Honestly I see no diffrence between drunk driving and distracted driving. Either way there's a risk that someone else will get hurt. My sympathy mainly goes to the families and friends. My friend Lukas was the distracted driver, he was texting his girlfriend when he went off the road and hit a pole. As much as I miss my friend, I'm glad that there was no one else in the car with him and that only he was the only one who had to suffer.
